Check who you're allowed to email

UK marketing law treats some businesses like private individuals. Get this wrong and you're spamming.

  1. Under the UK's electronic marketing rules (PECR), the ICO's guidance ↗ splits businesses into two groups:

    • Limited companies, LLPs and other corporate bodies: you can send them a marketing email without asking first.
    • Sole traders and some partnerships: these count as individuals. You can only email them if they've specifically agreed to it.
  2. Most small local businesses (plumbers, cafes, salons) are sole traders. To check, search the business name on Companies House ↗. If it shows as an active "Ltd", you can email. If it's not there, treat it as a sole trader: phone them or walk in instead.

CarefulEvery marketing email must say clearly who you are and give a simple way to opt out ("reply STOP and I won't contact you again"). If someone says no, keep a list and never contact them again. The ICO also expects you to check business phone numbers against the TPS and CTPS ↗ do-not-call lists before cold-calling.

CheckpointFor your first business, you know whether it's a limited company (email is fine) or a sole trader (phone or visit).
